The report emphasizes that the U.S. Department of Justice’s stance is that “the Constitution categorically prohibits prosecuting a sitting president, regardless of the severity of the alleged crimes or the strength of the evidence.” This position is fully endorsed by the Special Counsel’s office. The document further states, “Had Mr. Trump not been elected and his imminent return to the presidency not been a factor, the evidence available would have been sufficient to secure a conviction in a trial.”
