« Worksite Risks » and « Decennial Civil Liability » Insurance to Become Mandatory in Morocco
The Insurance and Social Welfare Supervisory Authority (ACAPS) and the Moroccan Insurance Federation (FMA) have announced that « Worksite Risks » and « Decennial Civil Liability » insurance will become mandatory as of December 30, 2024.
According to an ACAPS statement, this obligation follows the publication of two ministerial decrees in the Official Gazette. The first decree pertains to construction-related insurance, while the second establishes standard general conditions applicable to these mandatory insurance contracts.
The new regulations aim to better protect parties involved in construction projects and ensure compliance with regulatory standards. They outline minimum standards, including coverage limits, applicable deductibles, exclusions, and general terms.
The « Worksite Risks » insurance covers the duration of the works and includes two main guarantees:
- Damage coverage for physical deterioration of the construction site.
- Civil liability coverage for financial consequences of damages caused to third parties.
Meanwhile, the « Decennial Civil Liability » insurance, mandatory for architects, engineers, and contractors, takes effect upon project delivery and remains valid for ten years. It covers damages compromising the structure’s integrity, such as collapses due to construction defects or unsuitable materials.
These mandatory insurances apply to industrial, commercial, hotel, sports buildings, and residential buildings exceeding three stories or 800 m². Obtaining a certificate of occupancy or compliance will require presenting a decennial liability insurance certificate.
ACAPS and FMA will ensure the effective implementation of these obligations to provide optimal protection for insured parties and beneficiaries.
