Judicial Ethics: Sensitization and Guidance for Judges

During 2023, the Supreme Council of the Judiciary referred 55 judges to the disciplinary council to address the alleged misconduct attributed to them.

In its annual report submitted to King Mohammed VI and published in the Official Gazette, the Council noted that various sanctions were imposed on the judges concerned.

These sanctions, according to the same report, ranged from the dismissal of two judges, the mandatory retirement of 7 judges, to the temporary exclusion of 15 judges.

The Council mentioned that it made disciplinary decisions against two judges for unjustified absence, while issuing warnings to 12 judges. Fourteen judges received disciplinary reprimands, with two others receiving deferred decisions.

According to the same report, the Supreme Council of the Judiciary decided not to pursue responsibility against one judge, while continuing investigations against two others. Nine judges were declared not responsible while being issued a warning, and six others were acquitted, with two judges declared not responsible due to lack of accountability.

The Council did not stop its efforts to moralize the judiciary, having tasked the General Inspection of Judicial Affairs with overseeing the wealth of 15 judges and assessing the wealth of 36 others.

The president delegate issued a circular to all judges in the kingdom, urging them to adhere to legal provisions regarding asset declaration, paying close attention to this matter, ensuring accurate and comprehensive asset declarations, and updating them whenever there are changes in financial status.

The Council emphasized its commitment to the moralization project as a fundamental entry point for ensuring judicial security and strengthening trust in the judiciary system. It implemented a strategy encompassing three integrated approaches: awareness, guidance, and disciplinary measures.

Thus, according to the report submitted to the King, the Council introduced the Judicial Code of Ethics and explained its contents, both for practicing judges and for judicial trainees. The Ethics and Judges’ Independence Support Committee, a permanent committee under the Council, continued its work in supervising ethics advisors, guiding them, coordinating their efforts, and holding consultative meetings with them.
